How bad is it a payroll check forgery fraud and grand theft is please help?

i live with a woman have two kids and she signed my payroll check, put it in her cheking account and spend the money how bad is it is it jail time she is not a citizen but legal resident and can she loose the custody of the children please help the check was for 3250 dls
